National Herald Case -Recent developments


The National Herald Case is an ongoing case, filed by an eminent economist and politician Dr. Subramanian Swamy. This is against veteran politicians Sonia Gandhi and Rahul Gandhi and associated persons, alleging them of committing fraud and land grabbing to the tune of Rs 16 Billion by acquiring a public limited company called Associated Journals Limited (AJL). On Novermber 1, 2012, Dr. Swamy filed a private complaint in a court in Delhi asserting that both Sonia and Rahul , through this fraud had got the publication rights of National Herald and Quami Awaz Newspaper, with real estate properties in Delhi and Uttar Pradesh. He also claimed that the acquired place was given by the government only to the newspaper, but was used for running passport office with rental income amounting to millions of Rupees.

Recent developments in the case show that the BJP leader has demanded an SFIO Probe in the allegations of shareholders of AJL that they were not consulted before the transfer of the entire equity into Young Indian Pvt Ltd fund. His complaint which led to the summoning of Congress President Mrs. Gandhi and her son, also sought the takeover of AJL Properties in different cities by DDA as they had been “illegally transferred to Young Indian, which rented them out”. He also proclaimed that AJL shareholders are, “complaining that the transfer of freshly issued shares, which constituted more than 99 per cent of the total shares were carried without their knowledge or information”. The Gandhis and the other five accused — Suman Dubey, Moti Lal Vohra, Oscar Fernandez, Sam Pitroda and Young India Ltd — will have to appear in the Patiala house court on December 19.
Congress spokesperson alleged the ruling party of using the proxy litigation to attack senior congress leaders out of political malice and brushed aside suggestions that it was a major setback for them in the case. Noting that office-bearers of the Congress were in charge of the National Herald earlier and they remained the same in the new company, he wondered as to where has the cheating taken place, as alleged
